On May 22, Regulation (EU) 2024/1347 of the European Parliament and of the Council, of May 14, 2024 on standards for the qualification of third-country nationals or stateless persons as beneficiaries of international protection, for a uniform status for refugees or for persons eligible for subsidiary protection and for the content of the protection granted, amending Council Directive 2003/109/EC and repealing Directive 2011/95/EU of the European Parliament and of the Council was published in the DOUEL which will come into force on June 11.
Regulation establishes:
- rules regarding the requirements for the recognition of third-country nationals or stateless persons as beneficiaries of international protection;
- a uniform status for refugees or for persons eligible for subsidiary protection and
- regulates the content of the international protection granted.
In the Regulation, a series of substantial modifications have been introduced in Directive 2011/95/EU of the European Parliament and of the Council, repealing said Directive and replacing it with a Regulation with the idea of guaranteeing harmonization and greater convergence in decisions regarding asylum and regarding the content of international protection.
The Regulation does not apply to national humanitarian statuses granted by Member States to third-country nationals and stateless persons who do not fall within the scope of the Regulation. If national humanitarian status is granted, it should not pose a risk of confusion with international protection.
The Regulation, which will enter into force on 11 June, aims for a more consistent level of harmonization across the Union and to offer a greater degree of legal certainty and transparency, as indicated in its explanatory memorandum.
