{"id":5075,"date":"2026-09-25T13:11:44","date_gmt":"2026-09-25T11:11:44","guid":{"rendered":"https:\/\/tradelex.com\/?p=5075"},"modified":"2026-10-06T13:55:51","modified_gmt":"2026-10-06T11:55:51","slug":"what-is-the-eu-blue-card","status":"publish","type":"post","link":"https:\/\/tradelex.com\/en\/2026\/09\/25\/what-is-the-eu-blue-card\/","title":{"rendered":"What is the EU Blue Card?"},"content":{"rendered":"<blockquote><p>The EU Blue Card offers highly qualified workers from outside the EU the opportunity to live and work in an EU Member State, provided they possess the necessary higher professional qualifications or, where applicable, relevant higher professional skills, as well as an employment contract or binding job offer lasting at least six months, with a salary equal to or higher than the average gross annual salary in the country concerned, but not exceeding 1.6 times that figure.<\/p>\n<p>The EU Blue Card is valid in 25 of the 27 EU Member States; it does not apply in Denmark or Ireland.<\/p><\/blockquote>\n<h6><strong>Does the EU Blue Card allow me to travel to other EU Member States?<\/strong><\/h6>\n<p>Yes. You may visit other EU Member States for up to three months (90 days) within a six-month period (180 days). You may also transit through other EU Member States en route to the Member State where you reside and work.<\/p>\n<h6><strong>Can I work in other EU Member States?<\/strong><\/h6>\n<p>After 12 months, you may move to another EU Member State to take up highly qualified employment. You must apply for a new EU Blue Card in the Member State to which you wish to move. Please note that EU Member States have different rules regarding this.<\/p>\n<p>After residing legally for 12 months in the Member State that issued the EU Blue Card, you may move to, reside in, and work in another Member State with your family.<\/p>\n<h6><strong>Regulations<\/strong><\/h6>\n<ul>\n<li><a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2021\/1883\/oj\/eng\">Directive (EU) 2021\/1883 of the European Parliament and of the Council<\/a> of 20 October 2021 on the conditions of entry and residence of third-country nationals for the purpose of highly qualified employment.<\/li>\n<li><a href=\"https:\/\/tradelex.com\/wp-content\/uploads\/2023\/05\/Ley-14-2013-de-apoyo-a-los-emprendedores-y-su-internacionalizacion.pdf\">Law 14\/2013 of 27 September<\/a> on support for entrepreneurs and their internationalization (Articles 61, 62, 71, and 71 bis).<\/li>\n<\/ul>\n<h6><strong>What requirements must I meet to apply for the EU Blue Card?<\/strong><\/h6>\n<ul>\n<li>Not be a citizen of a European Union, European Economic Area, or Swiss state, or a family member of citizens of these countries to whom the Union citizen regime applies.<\/li>\n<li>Not be present in Spanish territory illegally.<\/li>\n<li>Be over eighteen years of age.<\/li>\n<li>Have no criminal record in Spain or in the countries where you have resided during the last two years for offenses recognized under the Spanish legal system. Not be listed as inadmissible within the territory of countries with which Spain has signed an agreement to that effect.<\/li>\n<li>Hold public or private health insurance arranged with an insurance company authorized to operate in Spain.<\/li>\n<li>Possess sufficient financial resources for oneself and one&#8217;s family members during the period of residence in Spain.<\/li>\n<li>Provide proof of qualifications derived from higher education training lasting at least three years and equivalent to at least Level 2 of the Spanish Qualifications Framework for Higher Education; in the case of regulated professions, provide proof of official recognition (*homologaci\u00f3n*) in accordance with the relevant sectoral regulations.<\/li>\n<li>Present a valid employment contract or a firm offer of highly qualified employment for a period of at least six months, guaranteeing the worker continuous activity for the duration of the EU Blue Card&#8217;s validity.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">The conditions set out in the employment contract must comply with current regulations and the applicable collective bargaining agreement.<\/p>\n<p style=\"padding-left: 40px;\">The new salary thresholds (approved in 2026) for the Blue Card are as follows:<\/p>\n<p style=\"padding-left: 40px;\">\u2013 General threshold: \u20ac41,356.36<\/p>\n<p style=\"padding-left: 40px;\">\u2013 Reduced threshold: \u20ac33,085.09<\/p>\n<p style=\"padding-left: 40px;\">The reduced threshold may apply in the following cases:<\/p>\n<p style=\"padding-left: 40px;\">\u2013 Occupations with labor shortages included in groups 1 and 2 of the CNO-2011 classification, in accordance with current regulations.<\/p>\n<p style=\"padding-left: 40px;\">\u2013 Third-country nationals who obtained the required qualification within the three years prior to the EU Blue Card application.<\/p>\n<ul>\n<li>Present a valid travel document and, if necessary, a visa application or a valid visa.<\/li>\n<\/ul>\n<h6><strong>Required documentation<\/strong><\/h6>\n<ul>\n<li>Official application form MI-T (International Mobility \u2013 Principal Applicant), duly completed and signed by the company or the foreign professional.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">Family members: Application form for family member authorization. International Mobility \u2013 Family Member (MI-F): the standard, unified application form for residence authorization for family members belonging to the categories covered by Law 14\/2013 of September 27 on support for entrepreneurs and their internationalization.<\/p>\n<ul>\n<li>Complete copy of a valid passport or travel document.<\/li>\n<li>Original criminal record certificate(s) from the country or countries where the applicant has resided during the last two years. Additionally, a sworn statement declaring the absence of a criminal record for the past five years must be submitted.<\/li>\n<li>Proof of sufficient financial resources for the applicant and their family members during their period of residence in Spain; this may be demonstrated, as applicable, via the relevant employment contract, documentation proving a professional relationship, or documentation related to training activities.<\/li>\n<li>Public or private health insurance arranged with an insurer authorized to operate in Spain, unless the applicant is engaged in an activity that grants them insured status within the National Health System.<\/li>\n<li>Documentation proving the qualifications required to practice the profession:<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">-Higher education qualification that has been duly legalized or apostilled. If the applicant is being hired to practice a regulated profession, the qualification must be officially recognized (homologated); or<\/p>\n<p style=\"padding-left: 40px;\">-Comparable professional experience of three or five years, depending on whether the application is for a national residence authorization or if the applicant holds an EU Blue Card, respectively. For EU Blue Card applicants who are information and communication technology professionals or managers, the minimum required professional experience is three years within the last seven years.<\/p>\n<ul>\n<li>Documentation identifying the company requesting the authorization, in cases where the application form (MIT form) is not signed using the applicant company&#8217;s <em>&#8220;AC Representaci\u00f3n&#8221;<\/em> digital certificate or the digital signature of a company-authorized representative via the Electronic Registry of Powers of Attorney:<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">&#8211; Copy of the company&#8217;s Tax Identification Number (NIF) and a copy of the deed of incorporation, duly registered with the appropriate registry.<\/p>\n<p style=\"padding-left: 40px;\">&#8211; Copy of the public document proving that the person signing the authorization application holds legal representation of the company. Copy of the signatory&#8217;s NIF or NIE, or consent to verify their identity details via the Identity and Residence Data Verification System.<\/p>\n<ul>\n<li>Copy of the employment contract signed by both parties.<\/li>\n<li>Proof of payment of the corresponding fee.<\/li>\n<\/ul>\n<h6><strong>Procedure<\/strong><\/h6>\n<ul>\n<li><strong>Party authorized to submit the application<\/strong>: the foreign company or professional to be recruited, acting either personally or through an authorized representative holding legal power of attorney for the business.<\/li>\n<li><strong>Place of submission:<\/strong><\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">Electronically, via the electronic office of the Large Companies and Strategic Groups Unit (UGE-CE).<\/p>\n<ul>\n<li><strong>Applicable fee:<\/strong> payable upon acceptance of the application for processing; payment must be made within ten business days:<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">Form 790, code 038, heading 7.1: \u201capplication for international mobility authorizations (Law 14\/2013) \u2013 initial residence authorization.\u201d<\/p>\n<ul>\n<li><strong>Application processing timeframe<\/strong>: twenty days from the electronic submission of the application to the competent processing authority. If no decision is reached within this period, the authorization shall be deemed granted by administrative silence.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">The decision will be notified to the employer and communicated to the worker.<\/p>\n<ul>\n<li>If granted, the worker has one month from the date of notification to the employer to personally <strong>apply for the visa at the Diplomatic Mission<\/strong> or Consular Office serving the area of \u200b\u200btheir residence. The visa application must be accompanied by:<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">&#8211; A valid passport or travel document recognized in Spain, with a minimum validity of one year.<\/p>\n<p style=\"padding-left: 40px;\">&#8211; A criminal record certificate issued by the authorities of the country of origin or of the country or countries where the applicant has resided during the last five years.<\/p>\n<p style=\"padding-left: 40px;\">&#8211; A medical certificate.<\/p>\n<p style=\"padding-left: 40px;\">&#8211; A copy of the contract signed by the parties.<\/p>\n<p style=\"padding-left: 40px;\">&#8211; Proof of payment of the visa fee.<\/p>\n<p style=\"padding-left: 40px;\">The Consular Office or Diplomatic Mission will issue a decision on the application within ten business days.<\/p>\n<ul>\n<li>Once the visa grant has been notified (where applicable), the worker must collect it in person<strong> within one month<\/strong> of the notification date.
